Terms of Service

These Terms govern your use of HaulHarbor, a service operated by Zphere Media LLC (“HaulHarbor,” “we,” “us”). By creating an account or using the service, you agree to them. Contact: support@haulharbor.com.

You must be at least 18 years old and able to form a binding contract.

Keep your credentials confidential and tell us promptly if you suspect unauthorized access. You are responsible for activity under your account.

Use HaulHarbor only for lawful purposes related to your own inventory and sales workflow. You may not: (a) scrape, crawl, harvest, or systematically extract data from the service outside normal product use; (b) reverse engineer, decompile, or attempt to discover source code or underlying models except to the extent such restriction is prohibited by law; (c) access the service through automated means (bots, scripts, or bulk API-style access) beyond features we expressly provide; (d) resell, rent, sublicense, or provide access to HaulHarbor to third parties as a service bureau without our written permission; (e) probe, scan, or test vulnerability of the system except with our prior written consent; (f) interfere with other users or abuse the service; or (g) use the product to violate third-party rights or marketplace rules.

You retain ownership of your inventory, sales, and uploaded content. You grant HaulHarbor a limited license to host, process, and display that data solely to provide the service you request (including marketplace sync and exports).

HaulHarbor, including its software, design, trademarks, and documentation, is owned by Zphere Media LLC and its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the service for your internal business purposes. No other rights are granted. You may not copy, modify, distribute, or create derivative works from our materials except as allowed by these Terms or written permission.

If you connect eBay, you authorize us to access and process data within the permissions you grant. You agree to be bound by eBay's terms and policies applicable to your use of eBay features. eBay is a third-party beneficiary of these Terms and may enforce them directly against you, including by terminating your access to eBay-related features. Your access to eBay-related features may be suspended or terminated at any time. Disconnecting eBay stops further sync. HaulHarbor is not affiliated with or endorsed by eBay.

HaulHarbor offers a free plan (Deckhand) and paid plans (Skipper, Quartermaster, Harbormaster). Prices are shown in USD at checkout and may exclude applicable taxes.

Automatic renewal. Paid plans renew automatically each month or year (depending on the interval you select) at the then-current price for that plan and interval until you cancel.

Quartermaster trial. The Quartermaster plan may include a 14-day trial. A payment method is collected at Stripe Checkout. Unless you cancel before the trial ends, you will be charged for Quartermaster when the trial ends (day 15) and the subscription will renew automatically thereafter until canceled.

How to cancel. You may cancel anytime online in Settings → Billing → Manage billing (Stripe customer portal). After you cancel, you keep paid access until the end of the current paid period; then the account returns to the free plan. We do not refund partial periods. Canceling stops future charges after the current period ends.

Price changes. If we change prices, we will give advance notice before the new price applies to a renewal.

Active item caps and downgrades. Each plan has an active-item limit (sold history does not count toward the cap). If you are over your plan's cap—including after a downgrade—you generally cannot add new active items until you are within the limit or upgrade. We do not delete your existing data solely because you exceed a cap.

Deckhand signup. Creating a free Deckhand account does not require a card. Starting a paid plan or Quartermaster trial does.

HaulHarbor is an inventory and reporting tool. It is not tax, accounting, or legal advice. Imported and calculated figures can be incomplete or wrong. You are responsible for verifying numbers before you rely on them (including with a qualified professional when needed).

HaulHarbor may offer optional AI features that suggest titles, descriptions, categories, or details derived from text or photos you provide. AI outputs can be incomplete, outdated, or wrong. You must review suggestions before relying on them, applying them to inventory, or using them in marketplace listings. You remain responsible for the accuracy and legality of content you publish.

eBay, Stripe, Google sign-in, OpenAI, Google Gemini, and similar services are controlled by those providers. Their outages, rule changes, or errors are outside our control. AI providers we use (including OpenAI and Google Gemini) are third-party services; their availability, policies, and outputs are outside our sole control.

If you send ideas, suggestions, or feedback about HaulHarbor, you grant us a perpetual, worldwide, royalty-free license to use, modify, and incorporate that feedback without obligation or compensation to you. Feedback does not include your inventory, sales, or uploaded content, which remain yours under “Your data.”

By creating an account or providing your email, you consent to receive electronic communications from us related to the service (for example account, security, billing, and product notices). You may manage certain preferences in Settings or by following unsubscribe instructions in marketing emails, where offered. Transactional messages required to operate the account may still be sent.

We may change, suspend, or discontinue features, plans, or the service as a whole, with or without notice, except where notice is required by law or by your subscription terms. We are not obligated to maintain any particular feature indefinitely.

We aim for reliable service but do not guarantee uninterrupted or error-free operation. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAULHARBOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF THE FEES YOU PAID TO HAULHARBOR FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR US $100.

You will defend and indemnify HaulHarbor and its operators against claims, damages, and expenses arising from your misuse of the service, your content, or your violation of these Terms or marketplace rules.

You may stop using HaulHarbor and delete your account at any time. We may suspend or terminate access for violations of these Terms, risk to the service, non-payment, or legal requirements. After account deletion completes (following any applicable grace period), your tenant data is removed as described in the Privacy Policy, except for limited records we may retain where required.

We may update these Terms. We will update the “Last updated” date and version. For material changes, we will provide reasonable advance notice where appropriate. Continued use after the effective date means you accept the updated Terms.

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. You and HaulHarbor agree to the exclusive jurisdiction of the state and federal courts located in New York, except that either party may bring an eligible claim in small-claims court. There is no arbitration requirement under these Terms.

Under California Civil Code §1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. You may also contact us at support@haulharbor.com.

If a provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms are the entire agreement between you and HaulHarbor about the service and supersede prior agreements on that subject. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. A failure to enforce a provision is not a waiver.
